ForePoint Networks, LLC has created this privacy statement ("Statement") in order to demonstrate our commitment to customer privacy. Privacy of your information is of great importance to us. Because we gather important information from our visitors and customers, we have established this Statement as a means of communicating our information gathering and dissemination practices. We reserve the right to change this Statement and will provide notification of the change at least thirty (30) business days prior to the change taking effect.
Collected Information:
We require customers who register to use ForePoint Networks services, including without limitation our public website and our Internet access service, (collectively, the "Services") to give us contact information, such as their name, company name, address, phone number, and e-mail address, and financial qualification and billing information, such as billing name and address, credit card number. At the time you express interest in attaining additional information, or when you register for a Service, we may also ask for additional personal information, such as title, department name, fax number, or additional company information, such as annual revenues, number of employees, or industry. Customers can opt out of providing this additional information by not entering it when asked.
ForePoint Networks may also collect certain information from visitors to and customers of the Services, such as Internet addresses. This information is logged to help diagnose technical problems, and to administer our Services in order to constantly improve the quality of the Services. We may also track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties.
Use of Information:
ForePoint Networks uses the information that we collect to set up and provide the Services for individuals and their organizations. We may also use the information to contact customers to further discuss customer interest in our company, the Services that we provide, and to send information regarding our company or partners, such as promotions and events. Customers are invited to receive an e-mail newsletter by providing an e-mail address. Customer e-mail addresses will not be distributed or shared. Separately, customers are also asked to provide an e-mail address when registering for the Service, in order to receive a username and password. We may also e-mail information regarding updates to the Service or company. Your e-mail address will not be distributed or shared with third parties except as provided herein. You can opt out of receiving any communication by contacting Customer Support; provided that opting out of certain communications may impair your use of the Services.
Agents or contractors of ForePoint Networks may have access to your personal information for the purpose of performing services on behalf of ForePoint Networks. All such agents or contractors who have access to your personal information are required to keep the information confidential and not use it for any other purpose than to carry out the services they are performing for ForePoint Networks or as otherwise required by law.
Except as we explicitly state at the time we request information, or as provided for in the ForePoint Networks Internet Service Terms of Use, we do not disclose to any third-party the information provided. All financial and billing information that we collect is used solely to check the qualifications of prospective customers and to bill for Services. This billing information is not used by ForePoint Networks for marketing or promotional purposes. ForePoint Networks may use a third-party intermediary to manage the credit card processing. Such an intermediary is solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing. Other third parties, such as content providers, may provide content on the Site but they are not permitted to collect any information nor does ForePoint Networks share any user information with these parties.
Customers of the Service may use the Services to host or transmit data and information ("Data"). ForePoint Networks will not review, share, distribute, print, or reference any such Data except as provided in the ForePoint Networks Internet Service Terms of Use, or as may be required by law. Individual records may at times be viewed or accessed only for the purpose of resolving a problem, support issue, or suspected violation of the Terms of Use, or as may be required by law.
ForePoint Networks may disclose personal information or Data if required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on ForePoint Networks; (2) protect and defend the rights or property of ForePoint Networks; or (3) act in urgent circumstances to protect the personal safety of users of ForePoint Networks, its Services, or the public.
If ForePoint Networks should ever file for bankruptcy or merge with, acquire, or get acquired by another company, we may sell the information you provide to us to a third party or share your personal information with any company related to such event or transaction.
Cookies:
When you interact with our Services, our web server may send cookies to your computer. Cookies are files that Web browsers place on a computer's hard drive and are used to identify customers and visitors who have visited the site previously.

Unless you choose to identify yourself to ForePoint Networks, either by responding to a promotional offer, or opening an account, you remain anonymous to ForePoint Networks. The Services contain links to other web sites. ForePoint Networks is not responsible for the privacy practices or the content of these other web sites. Customers and visitors will need to check the policy statement of these others web sites to understand their policies. Customers and visitors who access a linked site may be disclosing their private information. It is the responsibility of the user to keep such information private and confidential.
Security:
You are solely responsible for maintaining the secrecy of your passwords or any account information. Please be careful and responsible whenever you're online.
Our Services have security measures in place to help protect against the loss, misuse, and alteration of the Data under our control. When our website is accessed using Netscape Navigator, or Microsoft Internet Explorer versions 5.0 or higher, Secure Socket Layer (SSL) technology protects information using both server authentication and data encryption to help ensure that Data is safe, secure, and available only to you. ForePoint Networks also implements other security methods and hosts the Services in a secure server environment that uses a firewall and other technology to help prevent interference or access from outside intruders. Finally, ForePoint Networks provides unique user names and passwords that must be entered each time a customer logs on. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of Data.
Please keep in mind that we cannot control the security of your information outside of our facilities. As such, ForePoint Networks is not responsible for the security of any information outside of our facilities. Information being transmitted through the Internet will only be as secure as the encryption (if any) used to protect it. It is solely your responsibility to ensure that you take appropriate precautions before transmitting any information via the Internet to or from our Services.
Opt-Out Policy:
ForePoint Networks offers its visitors and customers a means to choose how we may use information provided. If, at any time after registering for information or ordering Services, you change your mind about receiving information from us or about sharing your information with third parties, send us a request specifying your new choice. Children's Privacy
The Services are not intended for or directed to persons under the age of 13. Any person who provides their information to ForePoint Networks through the account login page for new customers or any other part of the Services represents to ForePoint Networks that they are 13 years of age or older.
Correcting & Updating Your Information:
If customers need to update or change registration information they may do so by editing the user or organization record. To update a User Profile, log on to the Service and select My Setup to add or update information. To update Organization's data, log on to the Service and select Organization Setup. To update your billing information, please contact Customer Support.
